UTU - ATTACHMENT "A"

The following is a copy of the Section number 6 Notices served on the Carrier by The United Transportation Union in 1999.
Except as otherwise provided herein, effective January 1, 2000, the existing rules, agreements, interpretations or practices, however established, shall be amended to provide as follows:
ITEM 1 - WAGES
(a) General wage increases to become effective January 1, 2000, and every six (6) months thereafter, which shall be applied to all pay components, including but not limited to, arbitraries, differentials, miscellaneous rates, special allowances, daily, weekly, and monthly guarantees based upon hourly or daily rates of pay, including those expressed in terms of miles, and overmiles.
(b) Retroactive wage adjustments will be made by separate check or properly identified if included in regular check.
ITEM 2 - WAGES - 401K PLAN
(a) Provide for the establishment of an employer contributing 401-K Plan.
(b) The employee will have the option to select between participation in the 401K Plan and application of the general wage increase identified in Item 1.
ITEM 3 - COST OF LIVING
(a) Provide for Cost-of-Living Adjustments, and revise existing Cost-of-Living Allowance language.
ITEM 4 - NEW HIRES
(a) Eliminate entry rates.
(b) Eliminate the two-tier pay system so that all employees receive all arbitraries, special allowances and duplicate time payments regardless of their seniority date.
ITEM 5 - TRAINING
(a) Address training program issues, including increase in wages applicable to employees in training.
ITEM 6 - VACATIONS/ PERSONAL LEAVE DAYS
(a) Increase the number of vacation days which can be taken in single day increments.
(b) Reduce the number of years necessary to qualify for a vacation of 3, 4, or 5 weeks.
(c) Provide for a vacation of 6 weeks for 25 years service.
(d) Increase the number of split vacations from 5 to 6.
(e) Pro-rate vacation qualifications.
(f) Allow personal leave days for those employees who do not qualify.
ITEM 7 - SICK LEAVE
(a) Establish a plan under which the Carrier will provide benefits supplemental to Railroad Retirement benefits.
ITEM 8 - HOLIDAYS
(a) Add Martin Luther King's birthday.
(b) Paid holidays will become applicable to all employees where not now applicable.
ITEM 9 - MEAL PERIODS / MEAL ALLOWANCES
(a) Address needed improvements in employee meal periods and meal allowances.
ITEM 10 - RETIREMENT
(a) Address improvements in railroad retirement and health and welfare.
ITEM 11 - HELD AWAY FROM HOME TERMINAL
(a) Address needed improvements relating to Held Away From Home Terminal.
ITEM 12 - OVERTIME
(a) Establish a rule to provide for overtime when a road service employee has been on duty ten (10) hours.
(b) This rule will not apply where road service employees qualify for overtime in less than ten (10) hours on duty.
ITEM 13 - REST/FATIGUE
(a) Establish a rule to confirm the right of employees represented by UTU to mark off for rest opportunities to deal with fatigue-related problems and for family needs and emergencies related to quality of work life not covered by the Family Medical Leave Act.
(b) Establish a rule to provide for eight (8) hours pay for each one (1) hour an employee remains under pay upon expiration of the Hours of Service Law until arrival at the off-duty point.
(c) Establish a rule to provide for an eight (8) hour call.
(d) Address issues regarding correct train line ups.
ITEM 14 - TRAUMA LEAVE
(a) Establish a rule to provide for Trauma Leave.
ITEM 15 - OFF-TRACK VEHICLE ACCIDENT BENEFITS
(a) Address needed improvements in current agreements.
ITEM 16 - NATIONAL DISCIPLINE RULE
(a) Adopt and recognize national guidelines/principles for discipline.
ITEM 17 - SOURCE OF SUPPLY
(a) Train and Engine service employees will be the sole source of supply for yardmaster vacancies.
(b) Such vacancies will be filled by the senior UTU represented employee making application solely on a voluntary basis.
ITEM 18 - FLOW BACK
(a) Address flowback issues.
ITEM 19 - AMTRAK PASSES
(a) Establish a rule to allow unrestricted pass privileges for all UTU members, in addition to existing pass privileges.
ITEM 20 - MEDICAL LEAVE FOR INJURED, DISABLES OR CHRONICALLY ILL EMPLOYEES
(a) Establish a rule to confirm the rights of injured, disabled and chronically ill employees to be free from carrier demands that they report for duty and related carrier requirements.
ITEM 21 - LOCOMOTIVE REMOTE CONTROL/SCOPE RULE
(a) Establish provisions to confirm that the operation of remote control devices (black boxes) will be performed exclusively by employees represented by UTU.
(b) Establish provisions to prohibit change in crew positions on trains or engines including, but not limited to, co-engineer positions.
Nothing in this provision is intended to change, modify, or alter the specific practices or agreement provisions between the parties regarding the scope of duties held by employees represented by the UTU. Nothing in this provision is intended to alter the line of demarcation as established by existing agreements and practices.
