Before you read this message please go back to FYI and open and read the Carriers Section 6 Notices Attachment “B” UTU Section 6 Proposals November 1, 2004. Under STAFFING CONSOLIDATION Proposed Changes PART, A, Items: 1 through 4.

The Carrier wants a one person operation on all through freights. Should the Carrier successfully negotiate such an agreement and all pool and assigned service jobs are reduced to one person, what effect would this have on you?

Now close this window and go to CTY agreement Article 37 crew consist Part A. Road and Yard Crews, Item 1, and Part G Items 1 and 2 and you will find the following:    

ARTICLE 37

CREW CONSIST

A. ROAD AND YARD CREWS

  1. The consist of all road freight and yard crews, except as otherwise provided in this Article, will not be less than one conductor/foreman and one trainman/yardman.

G. RESTRICTIONS ON THE CARRIER

  1. Employees will not be required to operate with less than the required crew consist specified in this Article, nor will they be censured or disciplined in any manner for refusal to do so.

  2. No Carrier supervisor, yardmaster, official, engine or non-craft employee will be used to supplement, supplant or substitute in the work of any train or yard crew working under UTU Agreements.

The Carrier wants a one man crew.  The Conductors have a guaranteed position.

The sequence of events are as follows:

Carrier severs notice for a one person operation; UTU refuses to open our Crew Consist Agreement and.

WHAT'S WRONG WITH THIS PICTURE?

Does the UTU have something that the Carriers?

YES! CREW CONSIST!

Possessing an agreement is similar to possessing a home. You buy a home. You improve the home. Sometimes the home needs repair, but it belongs to you. You can sell it, you can trade it and you can give it away but no one can come in and take it. An agreement is much like this, you ratify it, and it becomes yours. You can improve it and sometimes it needs repair but it’s still yours. You can sell it, trade it and even give it away but no one can just take it.
